Not every single complaint warrants referral to the BCC. Director-General of Communications (DG Com) has the delegated powers from the CA to deal with complaints which are trivial or frivolous; which do not involve any breach of legislation, licence conditions or codes of practice; or falling outside section 11 of the Broadcasting (Miscellaneous Provisions) Ordinance (B(MP)O). In such circumstances, the complaints will be classified as a minor breach, unsubstantiated or outside section 11 of the B(MP)O as the case may be.
OFCA has set up a target to issue substantive responses to complainants within 21 days for complaints involving no investigation, and 8 weeks for complaints involving straightforward investigations, or report of progress to the complainant if result of cases is not ready within the above-mentioned period.
